REISSUING WORK PERMITS

I. Cases Requiring Reissuance of Work Permits

Foreign workers who have been issued a work permit that is still valid must reissue their work permits in the following cases, according to Article 12 of Decree 152/2020/ND-CP:

1. The work permit is lost.

2. The work permit is damaged.

3. Adjustments to information on the work permit such as: full name, nationality, passport number, workplace, or change of company name (without changing the business registration number).

Validity of Reissued Work Permits

The validity of the reissued work permit is calculated from the date of reissuance until the expiration date of the old work permit.

Example: Foreign worker Jane Smith was issued a work permit on December 1, 2023, which expires on December 1, 2025. On July 23, 2024, Jane Smith submits an application for reissuance of her work permit. The validity of the new work permit will be from July 23, 2024, to December 1, 2025.

II. Procedure for Reissuing Work Permits

1. Preparing the Application

The enterprise and the foreign worker need to prepare the application for reissuing the work permit, including the following documents:

- A request for reissuance of the work permit according to Form No. 11/PLI in Appendix I issued with Decree 152/2020/ND-CP.

- 02 color photos (size 4 cm x 6 cm, white background, facing forward, bare-headed, no colored glasses), taken within the last 6 months.

- The valid work permit that has been issued.

- In case the work permit is lost: a confirmation from the local police where the foreigner resides or an authority from the foreign country is required.

- In case of changes to the content on the work permit: supporting documents are needed.

2. Submitting the Application

- The enterprise submits the application online, directly, or via postal service to the Department of Labor, Invalids and Social Affairs where the enterprise is headquartered.

- If the enterprise is located in an industrial zone, the application is submitted to the Management Board of the provincial/city industrial zones.

- If it is under central authority, the application is submitted to the Ministry of Labor – Invalids and Social Affairs (Department of Employment).

3. Processing the Application

The competent state authority, after receiving a complete application, will reissue the work permit within 3 working days. If the reissuance is denied, a written response will be provided stating the reasons for the refusal.

4. Receiving Results and Paying Fees

- The fee for reissuing a work permit ranges from 300,000 to 450,000 VND per permit, depending on the locality.

- For example: Hanoi is 300,000 VND per permit, while Ho Chi Minh City is 450,000 VND per permit.

III. Application Documents for Reissuing Work Permits

Enterprises with foreign workers need to prepare the following documents:

1. A request for reissuing the work permit according to Form No. 11/PLI in Appendix I issued with Decree 152/2020/ND-CP.

2. 02 color photos (size 4 cm x 6 cm, white background, facing forward, bare-headed, no colored glasses), taken within the last 6 months.

3. The valid work permit that has been issued.

Note:

Documents related to foreign entities must be consular legalized and translated into Vietnamese, unless exempt from consular legalization under international treaties of which Vietnam and the foreign country are members, based on the principle of reciprocity, or according to legal regulations.
