Introduction to SHIN-ETSU CHEMICAL CO., LTD
SHIN-ETSU CHEMICAL CO., LTD, headquartered in Japan, is one of the world’s largest chemical corporations, well-known for its advanced technologies in silicon, industrial chemicals, and semiconductor materials. As a leading supplier in the global semiconductor value chain, Shin-Etsu consistently emphasizes the protection of intellectual property rights to safeguard its innovations and maintain competitive advantage.
In order to secure its industrial property rights in Vietnam, Shin-Etsu Chemical Co., Ltd officially authorized Á Đông IP to act as its representative for filing and handling all industrial design registration procedures. This authorization demonstrates Shin-Etsu’s trust in Á Đông IP’s legal expertise and professional capacity in the field of intellectual property in Vietnam.
On behalf of Shin-Etsu, Á Đông IP filed a series of industrial design applications before the Intellectual Property Office of Vietnam (IPVN) for semiconductor microstructure products. These designs are highly technical and play a crucial role in optimizing efficiency and improving performance in the semiconductor industry.
Following the initial examination, all applications filed by Shin-Etsu were accepted as valid, ensuring their eligibility to proceed to substantive examination.
During substantive examination, the IPVN concluded that the designs of Shin-Etsu fully met the protection requirements under the Intellectual Property Law of Vietnam, namely: novelty, creativity, and industrial applicability.
However, since several designs were found to have no significant differences, the Office required combination of certain applications in accordance with the regulations.
Ultimately, multiple Certificates of Industrial Design Patent (Bằng độc quyền kiểu dáng công nghiệp) were granted to Shin-Etsu Chemical Co., Ltd, officially recognizing its lawful ownership of the semiconductor microstructure designs in Vietnam.
