A patent is valid for 20 years from the filing date.
A utility solution patent is valid for 10 years from the filing date.
To maintain validity, the owner must pay an annual maintenance fee to the National Office of Intellectual Property (NOIP).
The maintenance fee for the following year must be paid within 6 months before the end of the current validity year.
It can be paid up to 6 months after the end of the validity year, but a late payment/surcharge fee will be charged for each month of delay.
If the fee is not paid within the prescribed time limit, the patent will cease to be valid from the start date of that validity year.

Prepare and file the maintenance dossier at the NOIP or its representative offices in Ho Chi Minh City/Da Nang.
NOIP will check the dossier and the payment of fees.
If valid, NOIP will record the maintenance of validity, update the Patent Register, and publish it in the Industrial Property Official Gazette.
It is recommended to pay the maintenance fee early within the 6 months before the end of the validity year to avoid late payment fees.
Verify the owner’s information before filing; if there is any change in name or address, the change recordal procedure must be carried out before or simultaneously with maintenance.
In case of co-ownership, all co-owners must agree to carry out the maintenance procedure.
