GUIDELINES FOR RENEWAL OF INDUSTRIAL DESIGN PATENTS
An industrial design patent is valid for 5 years from the filing date.
It can be renewed twice consecutively, each for 5 years, with a maximum total protection term of 15 years.
The renewal application must be filed within 6 months prior to the expiry date or no later than 6 months after the expiry date (late renewal fees will apply).
Original Industrial Design Patent (or reissuance application if lost).
Copy of the Enterprise Registration Certificate (if required).
Power of Attorney (as per the attached form, if filed through an industrial property representative). here
Filing: Submit the renewal application to the National Office of Intellectual Property (IPOVN).
Examination: IPOVN will examine the application within approximately 8–12 months from the date of receipt of a complete and valid dossier.
Renewal Decision:
If valid: IPOVN issues a renewal decision, records it in the Industrial Design Patent, and publishes it in the Industrial Property Official Gazette.
If invalid: IPOVN issues a notice of intended refusal, giving the applicant 1 month to correct deficiencies or file an objection.
It is recommended to file the renewal application early within the 6-month period before the expiry date to avoid incurring late renewal fees.
Ensure that the owner’s information in the Patent and the Enterprise Registration Certificate matches; if there are changes, recordal of changes must be carried out before or simultaneously with the renewal.
