Definition
Amending a trademark registration certificate is a legal procedure to update information that has changed compared to the details recorded in the protection title, without altering the nature of the trademark.
Cases Requiring Amendment
- Change of the name or address of the trademark owner.
- Amendment of the trademark specimen.
- Amendment or supplementation of the description of goods/services (within the registered scope of protection).
- Amendment of technical details, typographical errors, or the format of the certificate.
Required Documents
- Original Trademark Registration Certificate.
- Documents evidencing the change (new Enterprise Registration Certificate, amended trademark specimen, decision on name change/licensing, etc.).
- Power of Attorney: as per the attached form. here
Procedure
- Submit the application to the National Office of Intellectual Property (NOIP).
- Formality Examination: NOIP checks the validity of the application.
- Amendment Decision:
- If valid: NOIP records the amendment in the certificate, updates the Trademark Register, and publishes it in the Industrial Property Official Gazette.
- If invalid: NOIP issues a notice of intended refusal, giving the applicant 1 month to make corrections or raise objections.
Important Notes
- Any change related to the owner’s information should be carried out immediately after it occurs to ensure the legal validity of the certificate.
- If wishing to both renew a trademark and amend information, these procedures can be combined in a single application to save time and costs.
- If changing the name or address for multiple certificates at once, it is possible to carry out a single application for all such certificates.
