Due to the nature of funtional foods, if not strictly controlled, they can seriously affect consumer health. Therefore, the announcement of functional foods, including domestically produced and imported products, is a mandatory legal requirement.
Functional foods (TPCN) are food products designed to supplement and support the body's functions, aiming to maintain health, enhance immunity, and reduce the risk of disease. Due to the nature of these products, if not strictly controlled, they can seriously affect consumer health.
The announcement of functional foods is a mandatory legal procedure to bring products to market. According to regulations, all types of functional foods can only be circulated when they have been granted a receipt number for the announcement by the competent state management authority, in accordance with legal provisions.
According to the regulations of Vietnamese law, functional foods are divided into three main groups:
- Health-protecting foods: Support the improvement and maintenance of body health.
- Medical nutritional foods: Used for medical purposes, can be consumed via a feeding tube or orally, requiring supervision by healthcare staff.
- Foods for special dietary supplementation: Prepared according to special formulas, meeting the nutritional needs based on the individual's physical condition or medical status.
- Domestic products: Must announce compliance with functional food regulations and register the compliance document with the Ministry of Health (Food Safety Department).
- Imported products: Need to announce compliance with food safety regulations and register the announcement document in accordance with food safety regulations at the Ministry of Health (Food Safety Department).
- Food quality certification: Compliant with food safety regulations according to Decree 15/2018/ND-CP.
- Product standards: Bearing the seal of the organization or individual.
- Free sale certificate: Or health certification issued by the competent authority of the exporting country.
- Product sample and testing results: Within 12 months, issued by an accredited testing laboratory.
- Product label: Circulated in the country of origin and a Vietnamese label.
- Documentation proving functionality: Requires scientific evidence and the daily usage dosage.
- Certificate of food safety compliance: Meeting Good Manufacturing Practice (GMP) requirements.
- Registration letter for establishing a business: Or company establishment license.
- Compliance announcement document for functional foods: According to Decree 15/2018/ND-CP.
- Detailed information and complete sample: Testing results within 12 months.
- Label sample and scientific documentation: Proving the functionality of the product.
- Certificate of food safety compliance: Meeting GMP requirements.
- Manufacturing contract: Accompanied by GMP certification.
- Business registration letter: Or company establishment license.
- Step 1: The business submits the announcement documentation to the Food Safety Department.
- Step 2: The Food Safety Department receives and reviews the documents within 21 working days.
+ If the documents do not meet the requirements, the authority will request modifications and supplements once. Within 7 working days from receiving the modified documents, the authority will provide feedback.
+ If modifications are not made within 90 days after the request, the documents will no longer be valid.
Fees: The business must pay the document appraisal fee as stipulated.
After completing the procedures, information about the announcement will be published on the Ministry of Health's website at https://nghidinh15.vfa.gov.vn.
Businesses can check the status of their documents and update information if necessary.
