PROCEDURES FOR ANNOUNCEMENT

OF DOMESTICALLY PRODUCED COSMETICS

1. Conditions for circulation of cosmetics in the country

In order for cosmetics to be circulated in the country, organizations and individuals must:

- Have been granted a receipt number of cosmetic product declaration form by a competent authority, and be responsible for product safety, effectiveness and quality.

- Having a certificate of eligibility for cosmetic production and a cosmetic business code.

- Submit reports on cosmetic production and trading activities to the Department and the Ministry of Health annually (if the product has been previously announced).

- The product must be tested at a testing center to ensure that it does not contain prohibited substances and substances that are restricted from use.

- Fully pay the fee for announcement of cosmetic products according to current regulations.

2. Penalties for violations against regulations on cosmetic announcement

According to Decree 117/2020/ND-CP and Decree 124/2021/ND-CP, the fines include:

- A fine of between VND 10-20 million shall be imposed for the act of falsely declaring the contents in the announcement slip or changing the published contents without approval.

- A fine of between VND 20-30 million shall be imposed for circulating cosmetics without being granted a receipt number or having expired without re-announcing it.

- A fine of between VND 30-40 million shall be imposed for forging documents, using fake seals or forging signatures in the declaration dossier. In addition to fines, they can also be suspended from business for 3-6 months and forced to recall and destroy violating products.

3. Dossiers and procedures for announcement of domestically produced cosmetics

The dossier includes:

- Cosmetic product declaration form (02 copies) enclosed with the announcement data.

- A copy of the business registration certificate of the responsible organization or individual.

- Product quality test certificate. - Manufacturer's power of attorney (if any).

- The CD containing the publication dossier.

Procedures for submitting dossiers:

- Direct submission: The dossier is submitted at the Department of Health where the factory is located. After receiving a complete and valid dossier, the Department of Health will issue a receipt number within 3 working days.

- Online submission: Organizations and individuals submit dossiers via the web portal of the General Department of Customs. After completion, the dossier is processed and issued a receipt number as in the case of direct submission.

The announced receipt number is valid for 5 years, it needs to be extended at least 1 month before expiration. The disclosure fee is 500,000 VND/dossier.
